DNA Test Results in Court
The results of Home and Clinical Paternity Tests are not admissible as evidence in court cases. If it is your intention to use the results in a legal proceeding, you must select the Legal Test, which is administered, and documented by an impartial third party.

The Legal Test differs from our other Paternity Tests in two very important ways.

  • Positive proof of the identity of each participant is required and documented

  • The chain of custody for each sample collected is sworn to by the impartial witness.

 Only tests conducted and evaluated by AABB accredited laboratories are admissible in court.

 

Legal DNA Test Process
Advanced Paternity Legal Test kits all include specific instructions for sample collection and handling to the neutral third party witness.

  • The third party witness observes the entire testing process, and together with the tested individual(s), signs documentation verifying that the required procedures and safeguards were followed.

  • In the case of minors or other individuals who are not able affirm their willing participation, must be sworn by legal guardians.

  • Government issued photo identification (Driver’s license, Military ID, etc.) are required for positive identification of other tested parties.

 

Samples Required
Standard practice is that samples are taken from mother, alleged father and child. Cheek swabs or blood samples are both acceptable. Accuracy of the test is not affected by sampling method. Cheek (buccal) swabs certainly represent the easiest, least invasive sampling technique, but if blood samples are preferred, at least 5 ml of blood must be drawn from each donor, and the samples must NOT be frozen.
